Part A: Terms of Use
A1. Acceptance
By using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be at least 18 to create an account, apply or make a purchase. A parent or guardian may buy tickets for guests under 18 where the show allows them.
A2. Accounts
Give accurate information, keep your password private and tell us right away about any unauthorized use. You are responsible for activity on your account. We may suspend or close accounts that break these Terms.
A3. What you can do here
Learn about TBFW, buy tickets, buy training packages, apply as a model, designer, vendor, sponsor, press or ambassador, vote in live People's Choice voting when it is open, and use team and ambassador tools. Purchases and participation are also governed by the agreement that applies to them: the Ticket Terms, Coaching Terms, Model, Designer or Vendor Agreement, or Ambassador Agreement.
A4. Your content
You keep ownership of photos, videos, text and other material you upload ("Your Content"). You give TBFW a non-exclusive, worldwide, royalty-free license to host, display and use Your Content to run the Services and, if you submit it with an application or for promotion, to promote TBFW and its shows. You confirm you have the right to upload it and that it does not include anyone's image without their permission. We may remove content that breaks these Terms.
A5. Acceptable use
Do not harass, threaten or discriminate against others; post unlawful, hateful or explicit content; impersonate anyone; submit false applications, referrals or votes; use bots or scrape data; probe for security weaknesses; use AI-generated faces to misrepresent real people; or use the Services to sell unrelated products without approval.
A6. Purchases and payments
Prices are shown at checkout. Payments are processed by Square, and TBFW does not store your full card number. Refunds follow the terms for what you bought. Applying or paying does not guarantee selection, booking or representation. TBFW is not a modeling agency and does not represent models.
A7. Ambassador and team tools
Ambassador dashboards, referral codes and commission records are governed by the Ambassador Agreement. Team access to show details is for TBFW work only. We may correct errors in records and withhold commissions found to be fraudulent.
A8. Our content
The TBFW name, logos, designs, text, photos, curriculum and the Services belong to TBFW or its licensors. You may view them for personal use but may not copy, sell or reuse them without written permission.
A9. Disclaimers and liability
The Services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. To the extent the law allows, TBFW is not liable for indirect or consequential damages, and its total liability for any claim is limited to the amount you paid TBFW in the past 12 months.
A10. Changes, ending use and governing law
We may update the Services and these Terms and will post the new date. Continued use means you accept the changes. You may stop using the Services at any time. Tennessee law governs. Disputes go first to good-faith discussion, then mediation, then the courts of Davidson County, Tennessee.
Part B: Privacy Policy
B1. What we collect
| Category | Examples | Why |
|---|---|---|
| Account and contact | Name, email, phone, city, password | Create accounts, send confirmations and updates |
| Applications and profiles | Model, designer, vendor, sponsor, press or ambassador applications; photos and videos you upload; measurements and sizes you choose to share; social media links | Review applications, cast shows, assign looks, keep our directory |
| Photos and video | Images you upload, and photos and video we take at shows and training | Run the Services, promote shows, produce our magazine and series |
| Purchases | What you bought, amount, payment status (never your full card number) | Process tickets, packages, booths, sponsorships and commissions |
| Live voting | A device or phone identifier, so each phone gets one vote | Keep People's Choice voting fair |
| Usage and device | Pages viewed, device type, language setting, IP address, cookies | Keep the Services secure and working, and improve them |
| Messages | Emails, support requests, survey answers, reviews | Respond to you and improve |
B2. How we use it
To run and improve the Services, process payments, cast and run shows and training, check in guests with QR codes, run live voting, send confirmations and updates, promote TBFW with photos and video as described in our media releases and Ticket Terms, prevent fraud and meet legal duties. We send marketing emails only with an unsubscribe link in every one.
B3. Who we share it with
We do not sell your personal information. We share it only with:
- The services that help us run TBFW: Square (payments and tickets), Base44 (website and app), Cloudflare (file storage and email delivery), Resend (email) and our email inbox provider
- Designers, coaches, show staff and team members who need your details to run a show or training
- Sponsors, only as totals and never your contact details without your consent
- Authorities, when the law requires it or to protect safety and rights
Content that you or we publish, such as show photos, may be seen publicly.
B4. Our model, designer and vendor directory
When you apply, your application stays in our directory even if you are not selected for a particular show, so we can consider you for future shows. Being in the directory does not mean TBFW represents you. You can ask us to remove your application at any time.
B5. Cookies
We use cookies and similar tools to keep you signed in, remember your language and other preferences, and understand how the site is used. You can block cookies in your browser, but some features may not work.
B6. Your choices
You may ask to see, correct or delete your account information, remove your application from our directory, or take down a specific photo of you from our website and social channels. Email info@theblackfashionweekco.net and we will respond within 30 days. You can stop marketing emails with the unsubscribe link in any email. Some records, such as payments, signed agreements and printed publications, may need to be kept or cannot be recalled once published.
B7. Keeping and protecting your information
We keep information as long as needed for the purposes above and for legal and accounting duties, then delete it or remove what identifies you. We use reasonable safeguards, but no system is completely secure.
B8. Age
Accounts, applications and purchases are for adults 18 and older. We do not knowingly collect information from anyone under 18 and will delete it if we learn we have.
B9. Changes and contact
We will post updates here with a new date and tell you about major changes. These terms are also available in Spanish through the language toggle on our site; if the two differ, the English version applies.
